I refer my letter to Dame Sian Elias, Chief Justice of New Zealand,  copy  enclosed . . .

The letter to Dame Sian is self explanatory

Briefly:  I am an ex undercover agent and agent-provocateur who was the Crown’s principal witness in a series of drug trials that fully occupied one calender of a circuit court session presided over by Mr Justice Beattie in the Hamilton High Court during 1974

I now write and ask you to please send me the names of all my targets who appeared in your court — my intention being to approach each and every target who is still alive and apologise for the wrong I did

Dear Mr O’Brien,

I advise that I am unable to provide you with the names of the accused in Hamilton trials in which you appeared as a witness.  This information is not currently held by either the Ministry of Justice or the Hamilton Court but is in files held by Archives New Zealand.  Archives NZ have confirmed that they can not access particular files unless they have the file names and you have previously advised that you do not recall any of the names of the cases.  I advise that neither the Ministry of Justice nor the Hamilton Court have a search function able to identify cases in which you appeared as a witness in order to help you identify those cases.

It is my view that the organisation to which you should address your request is the NZ Police as the Police are more closely connected to the information you have requested.  Accordingly I have transferred your request to them.  I note that you have previously requested this information from them and you state that you “gave up trying when they kept using time extensions to stall my requests”.  I advise that you have the right, under s 67 of the Privacy Act, to make a complaint to the Privacy Commissioner if you are concerned that repeated use of time extensions “is or appears to be an interference with the privacy of an individual”.

I have spoken with the Police about this matter and they are currently working to identify the names of those you have requested but advised that it is taking some time due to the fact that your request relates to information created over 30 years ago.  Once they have provided you with the names of those involved, you can apply to the Hamilton Court for access to any additional information you seek from the Court files.

I note that the attachments to your initial email raised serious allegations of offending. Accordingly I advise that I have forwarded this correspondence to the Crown Law Office and you may be contacted in the near future to discuss the matter.
